कोलकोता कन्वेंशन सम्पन्न













हाल ही में कोकोता में पांच केंद्रीय श्रमिक संगठन कोयला उद्योग में हो रही निजीकरण के विरोध में एक कन्वेंशन किया था। इस कन्वेंशन में निजीकरण के विरोध में सितंबर २००७ को पूरा कोयला उद्योग में विरोध दिवस मानाने के निर्णय लिया। सारे कोयला कोम्पन्यों में कन्वेंशन करने का भी निर्णय लिया गया। कोल इंडिया मुक्यालय पर भी प्रदर्शन करने का निर्णय लिया गया। आगे की आन्दोलन की निर्णय इस के बाद में करेंगे। इस अवसर पर बी.एम्.एस के कर्यकर्तावों ने निजीकरण के विरोध में अपने बात सब के सन्मुख रखा।

DRAFT DECLARATION

The All India Coal Workers Convention being held in Kolkata on 26 August 2007 under the auspices of Indian National Mines Workers Federation (INTUC), Indian Mine Workers Federation (AITUC) Hind Khadan Mazdoor Federation (HMS) Akhil Bharatiya Khadan Mazdoor Sangh(BMS) and All India Coal Workers Federation (CITU) expresses grave concern at the serious situation prevailing in Coal industry which has dangerous implications for the public sector Coal Industry as well as 6 lakh Coal Miners working in the industry.

Though the Bill to denationalize Coal Industry has not been adopted in Parliament due to the united opposition of the entire T.U. movement in coal industry. The Government of India is resorting to back door privatization of the industry. Over 150 coal blocks have been offered to the private sector companies, while the Coal Ministry has decided to action these blocks. This will invite entry of unscrupulous private contractors who will resort to slaughter mining and exploit cheap labour without any proper working condition or T.U. rights. The safety of the mines will be callously ignored by them resulting in several accidents in privately run mines.

Already many mines have been allotted to private companies for power plants, cement factories etc. but they are illegally selling Coal in the market violating the national laws in a blatant manner.

The coal mine managements both in public and private sectors are resorting to outsource the jobs of permanent and perennial nature and exploiting the workers. The principle of equal wages for equal work is callously being ignored. In the name of patch work, large coal reserves are being handed over to the private parties who engage workers at extremely low rate of wages.

Over and above that, illegal mining is going on rampantly due to connivance of public sector mining officials and State Government administration. Several accidents have occurred in these mines and precious lives of workers have lost but no action is being taken to stop the malpractice.

The theft of Coal from public sector mines is a regular phenomenon resulting in loss of thousands of crores of rupees for Coal India every year. The corrupt officials are making money at the cost of public sector in connivance with traders in India.

The trade union movement has been demanding from the Government of India that the Coal India should be a unitary company and all coal companies should be brought under one umbrella. This will improve the functioning of the Coal industry and reduce the cost of administration. The loss making companies can get relief by forming such a single company. However, the Government of India has curtly ignored the just demands of the Unions in coal industry.

This Convention is of the opinion that Coal India can meet the entire requirement of Coal in India and there is no need to privatize the Coal industry. The trade unions in coal industry are prepared to give full co-operation to meet the requirement of India if the Govt. decides to develop coal industry only in public sector. This gesture however is not accepted by the Govt. and privatization drive is going on in full swing.

Instead of developing indigenous coal industry the Govt. of India is importing over 30 million tonnes of coal every year and closing down Indian mines despite huge reserves. The Govt. has formed Coal Videsh to produce coal in Australia, South Africa, Indonesia, Nigeria and other countries and ignoring the development of full potential of Coal Industry in India.

The development of coal industry is being adversely affected due to mismanagement and corruption prevalent in industry. Senior officers and contractors to-day are secretly funneling out huge resource of public sector coal companies which results in less profitability of our coal mines.

The drastic reduction of manpower is taking place through VRS, non-filling of vacancies, contracterisation of mining operation and other dubious methods in several departments there is shortage of manpower making the mining operation uneconomic.

The CIL management is unilaterally changing the terms of previous JBCCI agreements namely, employment to dependents. On the plea of Supreme Court judgment the Coal managements arbitrarily withdrew the agreement regarding job to dependents causing lot of resentment among the coal miners.

The managements are trying to withdraw the common weekly off to workers. The concept of all man all jobs is being arbitrarily implemented. The policies of the management are leading to weakening of the tripartite machinery at National level.

The Ministry of Coal is insisting that the wage agreement would be for a period of 10 years instead of for 5 years as prevalent in Coal industry. Despite rejection of the proposal by all the unions in coal industry the management are insisting on 10 year agreement.

The question of safety in Coal mines is sadly neglected and 200 lives are lost every year due to unsafe conditions in coal mines, while several thousands are getting injured. Many workers are affected by Pneumoconiosis but no steps are taken by the management to rehabilitate them. Pit safety committees are not functioning while some safety mechanism has become a ritual.

Thousands of tonnes of coal is getting burnt every day in Jharia area while subsidence of residential areas in several mines is of frequent occurrence. On both the issues dispite Supreme Court directive no step is being taken by the management which affects environment in the coal belt.

This Convention therefore demands that the following steps should be immediately taken by the coal managements and the Govt. of India.
  1. 1. Establish Coal India as a holding company with a single balance sheet along with all subsidiaries.
    2. Budgetary Assistance to be provided for expansion of coal mines in the public sector.
    3. Stop outsourcing and contractrisation in permanent and perennial nature of jobs in coal mines.
    4. The JBCCI Agreement relating to employment to dependents should be fully implemented.
    5. Stop illegal coal mining and theft of coal.
    6. Immediate starting of negotiation for a 5 year settlement in JBCCI.
    7. Ensure full safety measures in all coal mines.
    8. Ensure improved medical facilties for all workers and provide medical facilities to retired coal workers.
    9. Immediate steps to check the burning of coal in Jharia and subsidence of surface in collieries.
    10. Stop import of coal and develop more mines in India.

    The Convention therefore calls upon all workers to unitedly work to implement the following programme of action.
    1. Hold company level conventions to popularize the demands adopted by the convention.
    2. Observe National Protest Day in all the Coal mines on ______
    3. Hold company level demonstrations on ________
    4. Hold massive demonstration at CIL Headquarters on ______
    5. Organize nationwide strike of coal workers (Date and period to be decided by the convention).
This convention appeals to all coal mines in India to make this programme a grand success to protect the Coal industry in public sector and proper working and living conditions for the coal miners.

MINISTER'S VISIT TO WCL

MINISTER OF STATE FOR COAL DR. DASARI NARAYANA RAO VISITING WCL
Minister of State for Coal Dr. Dasari Narayana Rao is visiting WCL on 24th August 2007. The Minister will visit Saoner Mine No.3 in the morning and return to WCL Hqrs. to have a meeting with WCL Steering Committee.
He will proceed to Umrer in the evening to attend the "JEEVAN STHAR UTHAN" prize presentation and give away prizes to winners. He will proceed to Hyderabad in CIL aircraft at 8.45 p.m.
Unions are requested immediately send their suggestions to be raised in the meeting with the Minister.

Dear Sir,

Sub:- Expression of sense of gratitude and presentation of memento to the superannuating employees

Guidelines for disposal of Post Terminal Claim of retiring employees were circulated by the then Dy. GM(Co-Ordn) WCL vide No. 644 dtd. 25.9.1997 which include directive for issuance of letter expressing sense of gratitude for serving the company and also a memento of an amount not exceeding rupees one thousand to each retiring employee. The extract of relevant guideline is reproduced below:-

"MEMENTO; In order to ensure departure of every superannuating employee with grace and dignity it should be ensured that along with their settlement cheques, they are also handed over a letter expressing sense of gratitude for serving the company for decades. A memento of an amount not exceeding rupees one thousand in each case will also be presented to such employees."

It is observed that the above guideline is not being complied uniformly by all Areas/establishment. Accordingly, the matter was placed before Competent Authority, who has advised that the above directive should be implemented by all the Areas/Establishments of WCL uniformly.

Necessary action may be taken accordingly.

PROTECT RAMSETHU AND SAVE LIVELIHOOD OF TAMILNADU AND KERALA COASTAL FISHERMEN
Rama Sethu is an ancient monument of national and international importance, a monument of pristine glory of sacredness at the confluence of our holy motherland with life-giving waters of the Indian ocean currents. It is breathtaking geophysical reality a metaphor of a Civilisation enshrining good triumphing over evil.
Lakhs of fisherman all over Tamilnadu and Kerala are concerned over the avoidable destruction of the age old under sea bridge popularly known as RAMAR PALAM due to the implementation of the Setusamudram Channel project near Rameshwaram, entailing the demolition of a part of the Ramar Bridge (Ramsetu).
Many historical evidences are available to show that the bridge was called as Ramasethu. However it was later renamed a Adam's bridge. This is motivated action by colonial and imperialist administrators.
We believe that this under water wonder is the bridge constructed by Lord Shrirama with the help of wanaras during his campaign against Ravana, the then kind of Srilanka.
The satellite images released by NASA a couple of years ago confirmed that there indeed exist a bridge like construction in the seabed, thus fortifying the belief of a billion strong Indians. The Ramasethu is representative of Bharat's ancient and most highly revered civilisational history, and a cherished symbol ancient heritage.
Further, it is now proved that Ramasethu had acted as a "High wall" at the time of Tsunami, and in fact saved most of coastline west and northwest Dhanushkodi from devastation. It the Sethusamudram channel is dug through the bridge, then the devastation will be of unimaginable magnitude in case of another Tsunami.
Sir A R Mudliar committee report 1956 clearly stated that any idea of cutting the channel through Ramasethu should be abandoned because of the problems of maintaining a mid-ocean channel and the turbulence of the Indian ocean waters. Tsunami protection measures should be made an integral part of the project to prevent the devastation of Tamilnadu and Kerala coastline and destruction of Thorium and Titanium resource of Manmavalakuruchi, Kollam and Chavara. In case of another Tsunami caused by recurrent earthquakes in the Indian ocean region.
The demolition of Ramasethu will also cause enormous damage to the flora and fauna. The region of the Palk Straight and Manargulf has coral reefs with some of the richest bio-diversity and is the home of about 400 endangered marine species including turtles, dolphins and many variety of fish, all these will be destroyed and lakhs of fishermen will be deprived of their livelihood if the present form of Sethu samudram channel project is implemented.
The 112th All India Executive Committee of BMS met on 16th, 17th and 18th August, 2007 at Nagpur strongly condemn the proposal of "Sethu Samudram Channel Project" by breaking the 1775000 years old historic monument and demand the Government of India to make the project by any other alternative route or alignment without demolishing the Ramasethu. The Executive Committee also demand to the Government of India to declare the RAMASETHU AS AN ANCIENT HERITAGE MONUMENT.
The Executive Committee further directs the crore strong members of BMS to whole heartedly participate in Nation-wide Campaign to save Ramasethu and protect poor fishermen.

COMPREHENSIVE BILL FOR THE BENEFIT OF UNORGANISED SECTOR WORKERS

RESOLUTION
The National Executive Committee of BMS meeting at Nagpur on 16.8.2007 expressed regrets at the failure of the Government of India to place the approved draft of the Bill for the benefit of the unorganized sector workers, during the ongoing monsoon session of Parliament. A draft of Comprehensive Bill was first circulated by the GOI in the year 2004. Consultations were held at various fora, on several occasions, and the Bill underwent the process of redrafting. The Labour Minister and the Parliamentary Affairs Minister declared during May 2007 that the Bill would be placed in Parliament during the monsoon session, which is in session, currently. The National Executive Committee condemns the dilatory tactics of the GOI.
The National Executive Committee also expressed its dissatisfaction at the news that the GOI is thinking of passing the Bill in segments, and as a first step proposing to provide social security at few selected centers. BMS strongly disapproves the move and demands, that the Bill shall be comprehensive covering all aspect of workers including Employment Regulation, Safety and compensation for injury, social security and etc. and the benefit shall be available to all the eligible workers at all places, at the same time.
BMS demands that the proposed bill for the benefit of the unorganised sector workers be placed in the on going monsoon session of Parliament without any loss of time and be passed to provide succor to the exploited workers.

The Speecial Economic Zone Act is suicidal for our country. It would revive ZAMINDARI and PRINCELY system. Special Economic Zones would:-
  1. Deprive the lakhs of farmers and agricultural labours of their livelihood
  2. Create Foreign Territories in our motherland
  3. Cause revenue loss to the Nation to the tune of Rs. 1 lakh crores in a period of 5 years, as estimated by the Ministry of Fdinance
  4. Would revive bonded labour system, as many labour laws are exempted
  5. Would endanger the national "FOOD SECURITY"
  6. Would jeopardise the soverignty and freedom of our country
  7. Would create ecological problems.

BMS feel that SEZ is nothing but promotion of real estate business at the cost of the Nation. The Parliamentary Committee headed by Dr. Murli Manohar Joshi also suggested to the Government not to approve SEZs anymore. Considering all these vital factors, the National Executive of BMS at its 112th meeting held at Nagpur reiterates that the Central Government should immediately repeal the SEZ Act 2005.

RESOLUTION ON BONUS
This 112th Kendriya Kayra Samithi of BMS held on 16-17-18 August, 2007 at Nagpur expressed its deep regret for not effecting suitable amendment in Payment of Bonus Act 1965 enabling workers to get their Bonus, in spite of the written assurances by Dr. Manmohan Singh, Hon'ble Prime Minister, in the meeting with the Central Trade Unions held at his residence on 19 th August 2006.
It is to be noted that 41st Indian Labour Conference (ILC), the highest Tripartite Forum of our country held on 27-28 April, 2007 also unanimously passed the resolution in favour of the Amendment of the said Bonus Act but then also the Government could not get it amended from the Parliament till date.
After detailed discussion the house felt that, such delay is nothing but a delaying tactics of the Government with a view to deprive workers from getting their Bonus.
Although BMS is of the firm opinion that Bonus is a deferred wage and should be paid to all wage/salary earners, irrespective of any ceilings. We accepted up gradation in the ceilings in the ILC for the time being for the sake of unanimity.
Therefore, the Kendriya Karyasamithi warned the Union Government that, if the ceiling of the Bonus Act is not upgraded to Rs.3500/- at lower level and Rs.10000/- at upper level in the ensuing Monsoon Session of the Parliament, enabling workers to get their legitimate BONUS before October, 2007 (i.e. before Durga Pooja of the year) BMS will launch a strong Agitation throughout the country and for which Government would be fully responsible.
